Benefits for people from abroad

This two-day course aims to equip participants to advise claimants from abroad, both non-European nationals who may be subject to immigration control and European nationals. Using a step-by-step approach and practical examples, it helps advisers understand which tests apply and how they affect benefits and tax credit entitlements.

This two-day course covers:

  • Who is a ‘person subject to immigration control’ and how this affects entitlement they have to benefits and tax credits
  • The effect on benefits and tax credits of a change in immigration status
  • The benefit entitlements of ‘mixed households’
  • The residence requirements for benefits and tax credits
  • What factors are relevant in establishing habitual residence
  • How the right to reside test is applied taking account of recent caselaw developments Who has a right to reside

Benefits for Migrants Handbook

European nationals – benefit essentials half day NEW £25

There are special benefit and tax credit rules for people coming to the UK from Europe. Not everyone can claim, but often people who lose their jobs or cannot work are wrongly refused benefit. This half-day course aims to give a basic awareness and overview of the benefit rights of European nationals, and to help frontline staff signpost for advice more effectively.

The course includes:

  • An overview of the special benefit rules for European nationals (right to reside and habitual residence test)
  • An outline of the main circumstances when a European national can claim benefit
  • Rights of family members
  • Effective signposting

This course is aimed at those with little or no previous benefits knowledge. More experienced advisers should book on Benefits for people from abroad
