ESA – an introduction

Employment and support allowance (ESA) is for ill or disabled people who are unable to work. Assuming little or no previous experience of ESA, this course provides an introduction to the structure of ESA and the medical assessments.

The course covers::

  • Who is entitled to ESA
  • How the work capability assessment works
  • How to claim out-of-work benefits for ill or disabled people
  • An introduction to challenging decisions

Employment and support allowance (ESA) is the subject of considerable changes. This course looks at rules on ‘migration’ of claims for incapacity benefits to claims for ESA, the effect of other welfare reforms and – more widely – at appeal issues and tactics, including the developing body of caselaw. Among the subjects considered are:

  • Rules and procedures on the ‘migration’ of claims for incapacity benefits to ESA
  • Other welfare reforms
  • Entitlement to ESA while appealing, including in ‘migration’ cases
  • Important work capability assessment caselaw, appeal tactics and related issues

This course is aimed at advisers with a working knowledge of ESA, including of challenging decisions and representing at appeal tribunals.
