Employment and support allowance

This course provides a detailed introduction to employment and support allowance (ESA). Taking into account the experiences of claimants and advisers since ESA was introduced in October 2008, the course covers the structure of ESA, how and when assessments are carried out, and the requirements that most claimants must meet in order to avoid their benefit being reduced.
The course covers:
- Who is eligible for ESA
- How ESA is calculated
- The limited capability for work test and work-related activity test
- Conditionality requirements and sanctions
- How ESA affects entitlement to other benefits
- Transitional entitlement to the previous incapacity-related benefits
This course is suitable for anyone wanting to explore ESA in detail, including experienced advisers who want to update their knowledge.

Incapacity/limited capability for work appeals half day

This half-day course, aimed at experienced tribunal representatives, provides an overview of the main caselaw and other developments in ‘incapacity for work’ and ‘limited capability for work’, and considers the implications for tactics at tribunals. Among the subjects considered are:
- Caselaw – past trends, future prospects
- Medical evidence – its importance, use at a tribunal, how it is weighed
- Approaches to PCA/work capability assessment descriptors – working context, fluctuating conditions
The course will include the opportunity for representatives to share experiences and ideas.

The work capability assessment half day

A test of ‘limited capability for work’ applies to claimants of employment and support allowance. What is the work capability assessment? Who is subject to it? How will it work? This half-day course is for advisers wanting to familiarise themselves with the essentials of the test.
